Privacy Policy

Hesperos Labs LLC, a New York limited liability company ("Vesper," "we," "us," or "our"), operates shopvesper.com and the related features and tools we make available (together, the "Services"). This policy explains what personal information we collect, how we use it, who we share it with, and what choices you have.

1. Information You Give Us

• Waitlist information. If you join our waitlist before creating an account, we collect your email address. We use it to tell you when access is available. We keep waitlist entries for up to 12 months, and you can ask us to remove you at any time by emailing hello@shopvesper.com.
• Account information. Your first name, last name, email address, and password.
• Profile information. You may optionally add a profile photo and username. These are visible only to you — Vesper has no social or public-sharing features, and we do not display your profile to other users.
• Photos you upload. You may upload photos of yourself, photos of other people, and images saved to an inspiration board, so that we can find products similar to what appears in them.
• Style preferences. Brands, sizes, style choices, and similar preferences you provide to personalize your results.
• Communications. The contents of messages you send us, including support requests.

2. Photos in Particular

Because photos are central to how Vesper works and can involve people other than you, we want to be specific.

What we do with them. We process uploaded images to identify visual attributes — garment type, color, pattern, silhouette, and similar characteristics — in order to search for matching products. This processing is performed using the OpenAI API and the Google Gemini API, which act as our service providers under paid commercial terms.

What we don't do with them. We do not use your photos to train our AI models. We do not sell them or share them with advertisers. We do not display them to other users. We do not use them to identify or recognize individuals.

Photos of other people. If you upload a photo showing someone other than you, we process it in the same way and only to generate results for you. We do not build profiles of people who appear in uploaded photos. If you appear in a photo someone else uploaded and want it removed, email us at hello@shopvesper.com.

How long we keep them. We retain uploaded photos for as long as your account is active, or until you ask us to delete them. We do not automatically delete photos because an account has been inactive. You can ask us to delete individual photos or your entire inspiration board at any time by emailing hello@shopvesper.com. Deleted images are removed from backups within 90 days.

Retention by our AI providers. When we send an image for processing, our AI providers also retain it briefly on their own systems. OpenAI retains API inputs and outputs for up to 30 days for abuse monitoring before deleting them. Google logs inputs and outputs from the paid Gemini API for a limited period solely to detect violations of its usage policies. Neither provider uses this content to train or improve their models. These retention periods are set by the providers and operate independently of deletion requests you make to us, so an image you ask us to delete may persist briefly on their systems before their own deletion cycle removes it.

3. Information Collected Automatically

• Usage data. Features you use, pages you visit, products you view, searches you run, and timing of your activity.
• Device information. Device type, operating system, browser, IP address, and device identifiers.
• Cookies and similar technologies. We use cookies and similar technologies for essential site function, for analytics through PostHog, and for advertising measurement through Google Ads. We advertise Vesper on Google, and the Google Ads tag lets us see when someone who clicked one of our ads goes on to join our waitlist or create an account. The tag fires only at those two points — it does not run throughout the Services, and we do not use it to build advertising audiences or to show you Vesper ads as you browse other sites. You can control cookies through your browser settings. Disabling them may affect analytics and ad measurement but should not affect core functionality.

4. How We Use Information

• To create and manage your account and provide the Services.
• To generate personalized product results based on your photos and preferences.
• To help you discover products from retailers. We do not process payments for product purchases; you are redirected to the retailer's own site to buy.
• To respond to your inquiries and provide support.
• To send you service-related announcements.
• To send you marketing emails about new features, but only if you have explicitly opted in. You can unsubscribe at any time using the link in any marketing email or by emailing hello@shopvesper.com.
• To understand usage patterns and improve our features. This does not include training AI models on your photos.
• To advertise Vesper and measure whether our ads lead to signups.
• To protect the Services, prevent fraud, and secure accounts.
• To comply with applicable law.

5. Affiliate Commissions

We earn a commission on some purchases made through links on the Services. We source retailer product data and affiliate links through Channel3. Retailers and affiliate networks may set their own cookies or use tracking parameters when you follow a link, in order to attribute a purchase to us. That tracking is governed by the retailer's or network's own privacy policy, not this one. Commissions do not influence which products we show you.

6. How We Share Information

We do not sell, rent, or trade your personal information.

• Service providers. These providers act on our behalf and are contractually limited to using information to provide services to us:
  • Supabase — database, file storage, and authentication (including uploaded photos and account credentials)
  • OpenAI and Google (Gemini API) — LLM functionality and image processing, under paid commercial terms
  • Channel3 — retailer product data and affiliate product links
  • Amazon Web Services — transactional email delivery
  • Brevo — marketing email delivery, if you have opted in
  • Sentry — error monitoring and diagnostics
  • PostHog — product analytics
• Advertising. We use Google Ads to advertise Vesper and to measure whether people who click our ads go on to sign up. Google receives conversion events from our site and may process them under its own terms rather than solely on our instructions.
• Business transfers. In a merger, acquisition, or sale of assets, information may be transferred as part of the transaction. We will notify you before your information becomes subject to a different privacy policy.
• Legal requirements. Where required by law or legal process, or to protect the rights, property, or safety of Vesper, our users, or others.
• With your consent. For any other purpose you agree to.

7. Retention

• Waitlist information: retained until you create an account or ask to be removed, and in any case no longer than 12 months.
• Account information: for as long as your account is active, plus a reasonable period afterward to meet legal obligations.
• Uploaded photos and inspiration boards: as described in Section 2, including the separate retention periods applied by our AI providers.
• Usage and analytics data: retained indefinitely.

You may request deletion of your account and associated data at any time by emailing hello@shopvesper.com. On deletion, we delete or de-identify your personal information except where we are required to retain it.

8. Security

We use technical and organizational measures appropriate to the sensitivity of the information we hold, including encryption in transit and at rest, access controls, and secure storage. No system is perfectly secure, and we cannot guarantee absolute security.

9. Your Choices and Rights

Depending on where you live, you may have the right to access, correct, delete, restrict, or object to our processing of your personal information; to receive a copy in a portable format; and to withdraw consent where we rely on it.

To exercise any of these — or to delete your account, individual photos, or your inspiration board — email hello@shopvesper.com. We will respond within the timeframe required by applicable law and will not discriminate against you for exercising a right.

10. Age Requirement

The Services are intended for adults. You must be at least 18 years old to use the Services, and we do not knowingly collect personal information from anyone under 18. If you believe someone under 18 has provided us information, email hello@shopvesper.com and we will delete it and close the account.

11. Users Outside the United States

We operate from the United States. If you use the Services from elsewhere, your information will be transferred to and processed in the United States, which may have different data protection laws than your country.

12. Changes

We may update this policy. If changes are material, we will notify you by email or through the Services and update the date above. Prior versions are available on request.
